Important Notice

Before using AI Diary services, please read and fully understand all terms of this Agreement, especially the clauses highlighted in bold. Key clauses include, but are not limited to, user rules, membership rules, disclaimers, agreement updates, and dispute resolution.

By accessing or using AI Diary services, you are deemed to have read and agreed to all terms of this Agreement.

If you do not agree with any term of this Agreement, please stop using the services immediately.

1. About Us

AI Diary is a diary recording and management service provided and operated by the AI Diary development and operations team ("we", "us", or "our").

These AI Diary Terms of Service ("this Agreement") are a valid agreement between you ("you" or "user") and us regarding your use of AI Diary services.

2. Scope and Acceptance

  1. This Agreement, its supplemental agreements, and any single-page rules or operation prompts shown in the app (collectively, "this Agreement") are the rules based on which we provide AI Diary services, and you must comply with them.
  2. This Agreement, the AI Diary Membership Service Agreement, the AI Diary Recharge Service Agreement, and the Privacy Policy together form the complete rule system. If there is any inconsistency, the specific agreement for that matter shall prevail.
  3. Please read all terms carefully, especially clauses in bold.
  4. If you have any questions about this Agreement or any page prompt, please do not proceed and contact us through the "Contact Us" section.
  5. By using AI Diary services, you are deemed to have read and agreed to be bound by this Agreement.

3. Requirements for Using the Services

  1. You must have full civil capacity to use AI Diary services. If you are a person without or with limited civil capacity, you must read this Agreement under guardian guidance and use the services only with guardian consent.
  2. You represent and warrant that you have the legal rights and capacity required to enter into and perform this Agreement, and that doing so does not cause you to breach any obligation to any third party.
  3. If your country or region excludes all or part of this Agreement, you must stop using the services immediately; otherwise, continued use means you agree to bear related legal risks.

4. Service Content

  1. AI Diary is an internet-based (including mobile internet) diary recording and management platform through which you can use relevant features and services.
  2. The services include free features and paid membership features. Membership uses a "credit redemption" model and does not include any auto-renewal mechanism. The scope, validity period, pricing, and refund rules of membership are subject to the AI Diary Membership Service Agreement, the AI Diary Recharge Service Agreement, and the purchase page.
  3. We may adjust service content within a reasonable scope based on laws, regulatory requirements, operational strategy, or product upgrades, and will notify you through in-app pages or other reasonable means.

5. User Rules

  1. Operations and instructions made through your account are deemed your own actions, and you are responsible for their consequences. Any risks or losses caused by account/password misuse, theft, or unauthorized use due to your reasons shall be borne by you.
  2. When using AI Diary services, you shall provide and verify relevant information truthfully, accurately, and completely.
  3. You should evaluate your own needs and make your own decision before using the services.
  4. If losses are caused by your own input errors, improper operation, or wrong selection, you shall bear the consequences yourself.

6. Disclaimer

  1. Our services are provided through internet and telecom networks, and you should fully understand related network risks before use.
  2. Service failure, interruption, or delay caused by network failure, system maintenance/instability, hacker attacks, power failure, or third-party reasons does not constitute our breach, and we will make reasonable efforts to restore services.
  3. Services are provided on an "as is" basis. To the extent permitted by law, we are not liable for service interruption, delay, or obstruction caused by the following:
    1. Computer viruses, trojans, other malicious programs, or hacker attacks;
    2. Failure of your or any third party's device, software, system, network, or communication lines;
    3. Your improper operation or incorrect submission of information;
    4. Other circumstances beyond our control or reasonable foresight.

7. Prohibited Conduct

When using the services, you must comply with applicable laws and must not use the services for unlawful or non-compliant activities, including but not limited to:

  1. Publishing, transmitting, disseminating, or storing content that endangers national security, disrupts social order, violates public order and morality, or violates laws and regulations;
  2. Publishing, transmitting, disseminating, or storing content that infringes others' lawful rights and interests such as intellectual property rights or trade secrets;
  3. Fabricating facts or concealing truth to mislead or defraud others;
  4. Publishing, transmitting, or disseminating advertisements or spam information;
  5. Other acts prohibited by laws and regulations.

If your breach of this section causes any third-party damage, you shall bear independent liability; if it causes losses to us, you shall also compensate us.

8. Changes to This Agreement

  1. We may revise this Agreement when necessary, and you can review the latest version in the services.
  2. Revised terms take effect upon publication and replace previous terms. If a revision materially affects your rights and obligations, we will provide reasonable notice.
  3. After terms are changed, if you do not accept the revised terms, please stop using the services immediately; continued access or use means you accept the revised Agreement.

9. Governing Law and Jurisdiction

  1. The formation, performance, interpretation, and dispute resolution of this Agreement shall be governed by the laws of mainland China.
  2. The signing place of this Agreement is Wenzhou, Zhejiang Province, the People's Republic of China.
  3. Any dispute arising from or related to this Agreement shall first be resolved through friendly negotiation. If negotiation fails, either party may bring a lawsuit before a court with jurisdiction at the signing place of this Agreement.
